Terms and Conditions (T&C)
§ 1 Scope and Changes to these T&C
I. These terms and conditions (T&C) govern the contractual relationship established between the customer and "traffic.sekundensparer" regarding the paid services offered by traffic.sekundensparer in connection with the traffic exchange service. II. traffic.sekundensparer reserves the right to modify these T&C. The applicable version at the time of contract conclusion becomes part of the contract. III. Deviating T&C of the customer are not valid and will not apply, even if traffic.sekundensparer does not explicitly object to them.§ 2 Contract
I. By submitting an order via the booking form, the customer makes a binding offer that traffic.sekundensparer may accept within 14 days. The offer is accepted when traffic.sekundensparer sends an email with a booking confirmation, thereby forming a legally binding contract that includes these T&C. II. The customer can cancel the contract in writing or by email within 14 days after the conclusion of the contract without providing a reason (§ 312 d I BGB). The right of cancellation is excluded once the customer initiates the service through their account (§ 312 d III, 2nd Alt.). III. The customer confirms that if they are under 18 years old, they have obtained parental consent to enter into the contract.§ 3 Paid Services of traffic.sekundensparer
I. After the contract is established (§ 2) and the agreed payment is made, traffic.sekundensparer provides the customer with an account through which the booked service can be initiated. II. The specific services depend on the type of booking.- Advertising Account - (Banner view, Text link view, Click4Credits (forced clicks), Paid mail, and Website display) Upon receipt of payment, the customer receives login details for a sponsor account with a credit balance equal to the booking. If the customer already has a sponsor account, the new balance will be added to the existing account. Through the sponsor area, the customer can register one or more websites for display in the surf bar. The websites will be reviewed by traffic.sekundensparer and approved for display after acceptance. The website will not be shown to the same member again within 4 hours. traffic.sekundensparer provides a daily breakdown of impressions in the sponsor area.
- Member Account - (Banner view, Text link view, Click4Credits (forced clicks), Paid mail, and Website display) Upon receipt of payment, the customer receives login details for a member account with a credit balance equal to the booking. If the customer already has a member account, the new balance will be added to the existing account. The services are governed by § 3 II of the member rules. The customer may also use services under § 3 I and III of the member rules but must accept these rules alongside these T&C. In this case, an additional contract for unpaid services under the member rules arises.
§ 4 Customer Obligations
I. The customer must provide truthful information when booking online and promptly notify traffic.sekundensparer of any changes using the appropriate form available in the sponsor area (Profile). II. The customer must keep their password and other data confidential and change them immediately or request traffic.sekundensparer to do so if there is reason to suspect unauthorized access. III. In the case of services booked under § 3 II No. 1 and 2, the customer must only register permissible websites (§ 5, 5a, 5b) and permissible text links (§ 6). VI. The customer agrees to receive occasional emails about server outages, new features, bug fixes, and other news.§ 5 Permissible Websites
I. Content - Websites violating German law are not permitted, especially those containing child pornography, racism, warez, etc. Additionally, websites consisting solely of banner listings (pure banner pages) are prohibited. II. Scripts - Websites may not include scripts disrupting normal surfing behavior, including:- Scripts that bring the page to the foreground repeatedly in short intervals.
- Scripts causing additional windows (popups) to open when a page is accessed, closed, or viewed (exceptions in § 5a).
- Scripts breaking out of the surf bar frame (frame breakers).
- Scripts causing 100% processor usage on a standard computer (e.g., running texts in the status bar).
